General

These terms and conditions do not affect your statutory rights. To order goods through this website you must be at least 18 years of age and accept delivery within our served areas. We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.

Entire Agreement

All services provided to you by Microdream Ltd. are subject to these terms together with any previous written or verbal representations given or made by Microdream Ltd. or any representatives of Microdream Ltd.

Use of copyrighted material

Microdream Ltd permits you to view and use the material and data on this Site solely for your personal and non-commercial use. The content of this Site such as text, graphics, images, and other materials ("Materials"), are protected by copyright under both England & Wales and foreign law. Unauthorised use of the material may violate copyright, trademark, and other laws. You must retain all copyright and other proprietary notices contained in the original Materials and on any copies you make of the Material for your personal use.

You may not sell or modify the Material in any way for any public or commercial purpose. The use of the Material on any other web site or in any networked computer environment for any purpose is prohibited. If you violate the terms of this Agreement, Microdream Ltd. and Service Provider reserve the right to terminate your access to the Site, and you must immediately destroy any copies you have made of the Material.

Authority to use our data in a way that contravenes these conditions must come in writing from us, and will only be valid for the time period stipulated in the letter.

Bound by Consumer Law

We agree to meet the obligations set out under the consumer protection laws currently in force including:

  • the Consumer Protection Act. 1987;
  • the supply of Goods and Services Act 1982;
  • the Consumer Credit Act 1974;
  • the Consumer Protection (Distance Selling) Regulations 2000.
  • the Sale of Goods Act 1979;
  • the Trade Descriptions Act 1968;
  • the Unfair Contract Terms Act 1977 and the 1994 Regulations;

Description of Goods

All the products we sell are of a technical nature and it is not always practical or possible to publish detailed specifications of all the products. All images, descriptive matter, specifications and advertising on our site are for the sole purpose of giving an approximate description of the goods. Full detailed specifications are available from the manufacturer's themselves.

Typographical Errors

While we try and ensure that all prices on our website are accurate, errors may occur. In the event a product is listed at an incorrect price due to typographical error or error in pricing information from our suppliers, taxes or duty changes, we shall have the right to refuse or cancel any orders listed at the incorrect price whether or not the order has been confirmed. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund back to the original form of payment.

Privacy Policy Statement

We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998). We may use technology to track the patterns of behaviour of visitors to our site. This can include using a "cookie" which would be stored on your browser. By submitting information to Microdream Ltd, you consent to the collection and use of this information by Microdream Ltd. We do not sell, trade or rent your personal information to others, without your prior permission.

We do not store credit card details nor do we share customer details with any 3rd parties.

We use Internet standard encryption technology to scramble Your Personal Data when You transmit it to Us. This process is known as SSL (secure sockets layer) and We are constantly updating Our technology to provide You with the maximum practicable level of security. To check You are in a secure area of Our Web site You can look at the bottom right of Your browser window and You will see a closed padlock or an unbroken key. This indicates that SSL is enabled and Your transaction is secure.

Retention of title

(a)The goods shall remain the property of the seller until full payment has been received (each order being considered as a whole) or until prior resale in which case the beneficial and legal entitlement of the seller shall attach to the proceeds of the resale or to the claim on those proceeds.
 
(b)Upon taking possession of the goods the buyer shall be a bailee of the goods for the seller until title has passed to the buyer and shall store the goods upon its premises separately from its own goods and shall clearly mark its goods, so that they are clearly identifiable as the goods of the seller.
 
(c)The buyer’s right to possession of the goods will cease at the earliest of the following date:
i. On expiration of any agreed period of credit or the due date for payment of any invoice has passed.
ii. If being an individual he commits an act of bankruptcy or makes a proposal to his creditors or does anything which would entitle a petition for a bankruptancy order to be made, or the seller believes on reasonable grounds that the same is likely to occur.
iii. If being a company it goes into liquidation or does anything or fails to do anything which would entitle a receiver to take possession of any assets or which would entitle any person to present a petition for winding up or to apply for an Administration order or the seller believes on reasonable grounds that the same is likely to occur.
iv. If the buyer does or fails to do anything which may in any way imperil the title of the seller to the goods.
 
(d)The seller will have the right if paragraphs (a) (b) or (c) apply:
i. To repossess the goods
ii. To use or sell all or any of the goods
iii. To enter any premises of the buyer for the aforesaid purposes.

Delivery

We aims to deliver items ordered to you as soon possible. Units with software or components to be fitted please allow an extra 1-2 days. International orders are generally received in under 7 days.

To help you plan for your delivery, we will send you an e-mail with tracking details, as soon as your order has been shipped. You are also very welcome to contact us on the target delivery day, for a tracking update.

Our couriers do not work to predesignated time slots, or contact customers prior to delivery, so someone will need to be 'in' from 8am to 6pm on that day, at the delivery address, to sign for the goods. Because the items we sell are high risk, our couriers are legally contracted to deliver only to the delivery address given on order. If no-one is 'in' at the delivery address to sign, our couriers will not normally deliver to any other address (eg a neighbour's).

We wish that our delivery conditions did not have to be so stringent, but the IT industry is classed as 'high theft / fraud risk' by the Credit Card issuing banks and insurance companies, so I'm afraid that this has to be reflected in our delivery conditions - and also in our general terms and conditions, as shown below.

We ship Worldwide. International customers must request confirmation of shipping charges before buying or bidding for an item (Unless our system is automatically showing shipping charges for your destination).

Royal Mail Item Not received:

  • We rely on Royal Mail and have no control over their system. Royal Mail states that “Items cannot be considered lost until after 15 workings days(UK)/25 working days(International) of postage”.
  • We always offer replacement or full refund if parcel is lost in transit. We require a signed NON DELIVERY FORM, which you can fax or scan and email it to us, this is to avoid false claims. NON DELIVERY FORM can be downloaded from: http://microdream.co.uk/form/form.pdf

All items should be checked at the time of delivery for any damage or missing items. Failure to do so may affect any warranty claims that you make thereafter.

We cannot accept any notifications of damages where we are informed later than 7 days after you took delivery.

Warranty, Returns and Cancellations

Order Cancellations

You have the right to cancel your order at any time before a confirmed delivery date free of charge.

Business customers: We charge a cancellation fee of 15% of the item final price in the event of order cancellation.

Returns Policy

We want you to be satisfied when you shop with us. However, occasionally, we know that you may want to return items. For information on this process please see our returns policy below.

You must inform us of your wish to cancel in writing either by letter or email within a period of 30 days. The period of 30 days begins on the day after the day you receive your goods. You must take reasonable care of the goods and not use them.

Business customers have no rights to returns goods under the regulation.

Business customers: We charge a re-stocking fee of 15% of the item final price in the event that items are returned through no fault of our own (failed deliveries which are no longer wanted, purchase made in error, unsuitable etc.)

Business customers: We reserves the right to test "Unsuitable/ Faulty / Dead on Arrival" returns and impose a customer fee equal to 15% of the product sales price if the customer misrepresents the condition of the product. Any returned item that is damaged through customer misuse, is missing parts, or is in unsellable condition due to customer tampering will result in the customer being charged a higher restocking fee based on the condition of the product.

International deliveries: All costs with regard to returning and replacing units will be the responsibility of the purchaser.

All Goods returned must be returned including its original packaging.

Warranty

All orders come with a 12 month RTB (Return to Base) warranty (unless otherwise stated).

If there is a hardware fault after the first 30 days, you are responsible for safely returning the product to us. We can arrange collection for £19 including VAT. We will pay for the carriage of the replacement or repaired product back to you. It is always better to return the product in the same packaging used by us. Please ring us on 01803 269 861 to arrange this.

WHO IS COVERED? This warranty is non-transferable and covers only the original end purchaser. An original or copy of a sales invoice is required for warranty service.
WHAT IS COVERED? In the event of your PC hardware developing a fault you can return it for repair or replacement (or equivalent).
WHAT IS NOT COVERED?
  • Normal wear and tear of Product use
  • Misuse, lack of care, mishandling, accident, abuse or other abnormal use (Don't eat or drink over your laptop. Eating on your laptop or even in front of your laptop could lead to bits of food falling into the keyboard. Some liquid food being ingested by a user could also spill over the keyboard and lead to damages in the hardware components on the motherboard.)
  • Use of the Product other than for its intended purpose
  • Damage caused by improper or unauthorized repair or maintenance
  • Warranty is void if repairing without our consent or warranty seal is broken
  • Product that has been modified or altered
  • Software issues (any problems associated with software – whether bundled or installed by user, file corruption, internet setup etc.)
  • Accidental damage like breaking the screen or spilling liquid on it. You would need independent insurance to cover this.
  • Used batteries, although we do guarantee that it will hold at least one hour's charge. We will replace batteries which do not meet these criteria if reported within one week of receipt and the battery supplied is returned. Batteries are considered as consumable items - as they are expected to degrade over time. Some may require replacement.

If a product is returned under warranty and has been damaged, there is a software problem or there is no hardware fault at all, we reserve the right to charge for our labour and carriage costs.

Any device returned under warranty is factory reset as part of the repair process. MicroDream is not responsible for the damage to or loss of any programs, data, or removable storage media during the repair process.

Warranty returns will take approximately 7-14 working days to process once the goods have arrived (on rare occasions may take a bit longer due to work load).
